The Ca. Su. Ct. rules gay marriage is a fundamental right. If marriage is a religious concept this can not be true. If marriage is a State concept, a benefit granted by the State; the State can, thru the legislature, or by the people thru a prop, adjust or remove or modify that benefit without cause or reason for it is a privilege, not a right. If marriage is a religious concept the State can not make any laws regarding a sacred institution; Again, that would violate the 1st Amend. 'Make nor Law.' The US Supreme Court must first decide exactly what is the institution of marriage. A State concept which they can control or a religious concept which they can not control. No matter the test we need and must demand better educators, judges, religious leaders and politicians who make judgements on merit not emotion.
the state of california has voted on this twice that's all the do overs you get the people of the whole state have spoken stop telling everyone else what they 'have' to do.there is no gay marriage in california that's a reality..grow up ......

The issue I have with this case is political: it takes something that people voted on and, whether upholding or overruling, disregards those votes via a decision made solely from the judicial level. To me, that is a dangerous precedence to set for our fragile nation at this time.

My prayer is that the Supreme Court will uphold the people's vote and seek another way to deal with the issue of marriage.

You make excellent points...ones that should be visited, debated and freshly established prior to making laws; hence, prior to any Supreme Court ruling.

For the purpose of common-ground, I offer these statements from Wikipedia:

"In the early modern period, John Calvin and his Protestant colleagues reformulated Christian marriage by enacting the Marriage Ordinance of Geneva, which imposed "The dual requirements of state registration and church consecration to constitute marriage"[29] for recognition."

The issue, as I understand it from past research, is that gays say "civil unions" aren't good enough; they have to have a real "marriage". It's as if, IMHO, there's something more to marital unions than they experience. "Civil unions" fulfill (or at least should fulfill) the legal part of marriage.
I'd have to research this again to cite the source, but I understand they desire to be considered equal with respect to "spiritual recognition", expressed above as "church consecration".
Obligating a church to recognize a same-sex union as if "God-honored" is where the line is drawn by those who oppose same-sex marriage.

While denominations hold different beliefs/practices, it would be wrong to force a church to marry a same-sex couple simply because the state legalizes same-sex marriage. Such forcing doesn't resolve anything...it only takes oppression from one side and gives permission to the other to use it.
